Privacy of Consumer Information

Utah has a rule called the Privacy of Consumer Financial and Health Information Rule. It governs the treatment of nonpublic personal health and financial information about individuals by all Utah insurance licensees. This rule:

  • requires a licensee to provide notice to customers about its privacy policies and practices; notice must be provided when the licensee establishes a relationship with the customer;
  • describes the conditions under which a licensee may disclose nonpublic personal health information and nonpublic personal financial information about individuals to affiliates and nonaffiliated third parties; and
  • provides methods for individuals to prevent a licensee from disclosing that information; this is known as “opt out.”
